Course Policies

LIABILITY WAIVER AND USER AGREEMENT WAIVER OF LIABILITY, PHOTOGRAPHY/VIDEO RELEASE, INDEMNIFICATION AGREEMENT & STUDIO AND CLASS USE I hereby waive, release and discharge any and all claims and damages for personal injury, death, or property damage which I, or my minor children, may sustain or which may occur as a result of my own participation, or that of my minor children, with MUD STUDIO LLC. I further understand and agree that: 1. This release is intended to discharge in advance MUD STUDIO LLC, its owners, officers, employees, contractors, directors, agents and successors from and against any and all liability, except for their sole negligence or intentional acts, connected in any way with my participation or my minor children’s participation in MUD STUDIO LLC activities; 2. Such activities may be of a hazardous, strenuous, and/or physical nature, cause injuries and participation in said activities may result in injury, death or property damage; 3. Knowing the risk involved, nevertheless, I voluntarily request permission for myself or my minor child to participate in said activities; 4. I hereby assume any and all risks of injury, death or property damage and to release and hold harmless MUD STUDIO LLC, its officers, employees, contractors & agents, except for their sole negligence or intentional acts; 5. This waiver, release and assumption of risk is binding on me and my heirs and assigns; 6. I will indemnify and hold MUD STUDIO LLC harmless from any loss, liability, damage, cost or expense, including litigation, which it may incur as a result of any injury and/or property damage which myself or my minor children may sustain while participating in said activities; 7. I will compensate any loss, damage, or cost MUD STUDIO LLC may incur if any litigation arises due to any claim made by myself, said minors, or by anyone on said minor’s behalf; 8. MUD STUDIO LLC is not responsible for unattended children on the premises; 9. I expressly allow, and hereby waive any objection to, MUD STUDIO LLC photographing and/or videotaping of me and/or my minor children when I and/or my minor children are participating in MUD STUDIO LLC programs; 10. I understand and agree that all photographs and videotapes will remain the property of MUD STUDIO LLC, and that MUD STUDIO LLC may use such photographs or videotapes for archival and promotional purposes. CERAMICS CLASSES AND STUDIO USE I further understand and agree that: 1. I agree and understand ceramics is a multi-step process. There are many variables along the way that may result in breakage, color inconsistencies, etc. Therefore, while every effort is made, a fully functional end project is not guaranteed 2. Mud Studio reserves the right to reject any pieces for firing for the safety of the Kiln, Studio, Students & Staff 3. I understand that there are no refunds given for classes for any reason. Failure to attend does not entitle a participant to a transfer or a refund 4. Due to space limitations Make Up classes are not offered 5. Registration for a class is for a specific person, day and time and is not transferable to other times, days or people 6. I understand that Mud Studio is a community ceramics studio and will not be used for my own production pottery 7. I understand that any work left at Mud Studio unattended for over 30 days, Mud Studio is able to recycle, dispose or donate I have carefully read this Waiver of Liability, Photography/Videotape Release, Indemnification & Studio and Class Use Agreement and fully understand its contents. I am aware that this is a release of liability and a contract between myself and MUD STUDIO LLC, and that I sign it of my own free will.
